TERMS OF SERVICE
Dear customer,
Thank you for choosing our building restoration company to provide you with our services. We are committed to providing you with the highest quality of workmanship and service, and to ensure that you are fully satisfied with the results. Please find below the terms and conditions that will govern our relationship and the provision of our services to you.
1. Scope of Work
a) We will provide you with a proposal that will outline the scope of work required to restore your building, including any necessary materials, equipment, and labour.
b) Any changes to the scope of work must be agreed upon in writing by both parties before any work begins.
c) We will use our best efforts to complete the work within the timeline agreed upon in the proposal. However, we cannot be held responsible for any delays or issues that arise due to unforeseen circumstances beyond our control.
2. Quality of Work
a) We guarantee that all work will be completed in a professional and workmanlike manner and will be free from defects in workmanship.
b) We will use materials of a quality that is suitable for the purpose for which they are intended.
c) You agree to inspect the work upon completion and notify us of any defects or issues within seven (7) days of completion.
d) We will use our best efforts to remedy any defects or issues notified by you within a reasonable period of time.
3. Payment
a) We will provide you with a quote for the services to be provided and the payment schedule.
b) Payment must be made in accordance with the payment schedule set out in the proposal.
c) We reserve the right to suspend work if payment is not made in accordance with the payment schedule.
4. Liability and Insurance
a) We maintain adequate insurance cover for the provision of our services, including public liability insurance.
b) Our liability to you for any losses or damages arising from the provision of our services will be limited to the amount of the fee paid by you for the services.
c) We will not be liable for any indirect or consequential losses arising from the provision of our services.
5. Termination
a) Either party may terminate this agreement by giving written notice to the other party if the other party breaches any material term of this agreement and fails to remedy such breach within thirty (30) days of receipt of written notice.
b) Either party may terminate this agreement by giving written notice to the other party if the other party becomes insolvent, bankrupt, or enters into liquidation.
6. Confidentiality and Intellectual Property
a) We agree to keep confidential all information disclosed to us in connection with the provision of our services.
b) You acknowledge that all intellectual property rights in any reports or documents prepared by us in connection with the provision of our services will vest in us.
7. Governing Law and Jurisdiction
a) These terms and conditions will be governed by and construed in accordance with the laws of the jurisdiction in which the services are provided.
b) Any dispute arising in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of the jurisdiction in which the services are provided.
By engaging our services, you acknowledge that you have read and understood these terms and conditions and agree to be bound by them.
